The Prosecutor's Office is an independent justice system organisation. It ensures the implementation of the principle of uniform and correct application of the law throughout the country on behalf of the State. The Constitution emphasised that "The prosecutor shall exercise supervision over the inquiry into the investigation of cases and the execution of punishment, and shall participate in the court proceedings on behalf of the State". The organisation and work of the Prosecutor's Office is founded on the principles of being integrated and centrally headed, and not affected by external influence.

The Prosecutor's Office consists of:

  • The State Prosecutor General's Office
  • The Prosecutor s Office of Aimag and Capital
  • The Prosecutor s Office of Soum, Intersoums and Districts
The President appoints the Prosecutor General and his/her deputies in consultation with the State Great Khural for a term of six years. An Investigative Authorities office operates under the State General Prosecutor's Office. Adoption of the Strategic Plan of the Justice system in Mongolia by the State Great Khural on May 4, 2001 has become an important event
for the judiciary and law enforce-ment bodies of Mongolia. The Strategic Plan is a long term strategic document, which clarifies the direction of the development of bodies of the judiciary within the framework of Legal Reform. Last year, 17 new laws were drafted, 18 revised and 24 amended under legislative reforms planned up to 2004. The main aim is to put in place a new structure of law enforcement organisations, to improve their work, and ensure observance of human rights. The Criminal Code, Criminal Procedures Law, Civil Code, Execution of Court Decisions Law and a package of laws covering prosecutor and defence lawyers, were passed by the parliament and came into force on January 1, 2001.
